1. About Prime Deals

These Terms of Service govern access to and use of payprime-deals.com and purchases made through the website.

Prime Deals is the trading name used by Prashanth Kandhi, an individual operating as a sole trader established in Australia.

Prime Deals is not presented as a separate legal entity.

The store sells products online to consumers in the United Kingdom.

2. Acceptance of these terms

By accessing the website, customers agree to comply with the provisions governing use of the website.

When placing an order, customers agree that their purchase is subject to these Terms of Service together with the Return and Refund Policy, Shipping Policy and other information made available as part of the transaction.

Nothing in these terms limits mandatory consumer rights.

Product colours and appearance may vary depending on screens, devices and reasonable manufacturing differences.

Nothing in these terms permits Prime Deals to provide goods that fail to comply with mandatory legal requirements.

5. Prices and currency

Prices presented to customers in the United Kingdom are displayed in GBP unless clearly stated otherwise.

Applicable delivery charges and other mandatory charges known at checkout will be disclosed before the customer submits the order where required by law.

6. Orders and contract formation

Submitting an order constitutes an offer to purchase the selected goods.

An automated acknowledgement that an order has been received does not necessarily constitute acceptance where the communication clearly operates only as an acknowledgement.

A contract is formed when the order is accepted in accordance with the checkout and order-confirmation process, subject to applicable consumer law.

We reserve the right to reject or cancel an order before a binding contract is formed where there is a legitimate reason to do so.

Where payment has already been collected for an order that is subsequently validly cancelled by Prime Deals, the relevant amount will be refunded.

7. Payment

Customers must provide valid payment information and be authorised to use the payment method selected.

Payments may be processed using Shopify Payments and associated payment providers.

8. Pricing and description errors

If a genuine and material pricing, availability or description error is identified, we may contact the customer before fulfilment to explain the issue and, where legally permissible, provide appropriate options.

Nothing in this provision permits Prime Deals to disregard a binding contract or mandatory consumer rights where applicable law provides otherwise.

9. Order processing

Orders are normally processed within 2 business days.

Processing time is separate from the estimated delivery period.

Products are dispatched directly from China by a third-party supplier.

10. Delivery

After dispatch, estimated delivery is 5 to 8 business days.

Delivery times are estimates and are not absolute guarantees.

The Shipping Policy contains further information concerning dispatch and delivery.

11. Multiple-item orders

Where an order contains multiple products, fulfilment requirements may result in products being dispatched separately.

Customers may therefore receive more than one parcel for a single order.

12. Cancellation and refunds

Cancellation, refund and statutory consumer rights are explained in the Return and Refund Policy.

Where applicable, consumers purchasing online have statutory cancellation rights under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013.

These rights are separate from remedies available where goods are faulty, damaged, misdescribed or otherwise fail to comply with applicable consumer law.

13. Consumer Rights Act

Where the Consumer Rights Act 2015 applies to the transaction, nothing in these Terms of Service excludes or restricts rights or remedies that cannot lawfully be excluded or restricted.

Goods must satisfy the standards required by applicable law.

14. Intellectual property

Unless otherwise stated or legally permitted, website content, branding, text, graphics, design elements and other materials made available through Prime Deals may be protected by intellectual property rights belonging to their respective owners.

Users must not reproduce, distribute, commercially exploit or misuse protected materials without the necessary permission or another lawful basis.

15. User-provided content

Where customers submit reviews, comments or other content through functionality offered by the store, they must not knowingly submit unlawful, defamatory, infringing, fraudulent or malicious material.

Any use of customer-provided content by Prime Deals will remain subject to applicable law.

16. Third-party services

The store relies on third-party services, which may include Shopify, payment providers, suppliers, logistics providers and technology providers.

Third-party websites or services may be governed by their own terms and privacy policies.

Nothing in these terms excludes responsibility that applicable law places directly on Prime Deals.

17. Liability

Nothing in these Terms of Service excludes or limits liability where doing so would be unlawful.

In particular, nothing excludes or limits liability for fraud or fraudulent misrepresentation, or any other liability that cannot legally be excluded or restricted.

Nothing in these terms limits mandatory statutory rights available to consumers.

Any limitation of liability will apply only to the extent permitted by applicable law.

18. Suspension or termination of website access

We may suspend or restrict access to the website where reasonably necessary because of security concerns, suspected unlawful activity, misuse, technical requirements or other legitimate operational reasons.

This does not affect rights arising from orders already placed or contracts already formed.

19. Governing law and consumer jurisdiction

Because Prime Deals is operated by an Australian sole trader and sells to consumers in the United Kingdom, applicable law and jurisdiction may depend on the circumstances of the transaction and mandatory consumer protection rules.

Nothing in these terms deprives a United Kingdom consumer of mandatory protections that apply to the consumer and cannot lawfully be excluded by contract.

Nothing in these terms is intended to prevent a consumer from relying on mandatory jurisdictional rights available to them in the part of the United Kingdom in which they live, including England and Wales, Scotland or Northern Ireland, where applicable.

20. Changes to these terms

We may update these Terms of Service from time to time for future use of the website or future transactions.

Changes will not retrospectively remove rights that have already arisen under an existing contract.
